Who Is Exempt from Workers' Compensation?

Some workers’ compensation exemption examples in Minnesota apply to the categories below.
Employment Generally Excluded In Minnesota
- Employees of common carriers that are railroads—does not apply to longshore workers not employed by railroads.
- Employees covered under the Federal Employees’ Liability Act (FELA) or similar laws
- Farm Laborers and their immediate family members
- Volunteers
- Sole Proprietors and Closely Held Corporations
Other types of employment generally excluded include:
Casual Employees
This category generally includes employment situations that happen without regularity, are occasional, and of comparatively minor importance to the employee.
These types of employment situations are usually temporary or of a short duration. The employment must not be part of the employee’s usual course of trade, business, profession, or occupation of the employer.
Independent Contractors
Please note that it is not enough for an employer to simply call an employee an “independent contractor” for the purposes of this workers’ compensation exemption. This is a category with many exceptions to the coverage exclusion.

Household workers who earn above $1,000 in a three-month period may be eligible for workers’ compensation coverage and should contact an attorney to discuss.
